This issue, tied to HS code classifications, is critical for businesses importing aluminum products into the EU. Hereโ€™s what Iโ€™ve learned and how to navigate it to avoid unexpected costs.
The core issue often stems from customs reclassifying aluminum slugs (discs or circles) from HS 76169990 ("Other articles of aluminum") to HS 7606.XXXX (aluminum plates, sheets, and strips >0.2 mm). The latter is subject to EU anti-dumping duties of 14.3%โ€“24.6% under Regulation (EU) 2021/1784, which can feel like a 25% hit when rounded up. However, slugs correctly classified under 76169990 typically face no such duties.
How to Avoid the Anti-Dumping Duty:
1. Declare HS 76169990 Clearly: Ensure your import documentation specifies HS 76169990 for aluminum slugs, especially if theyโ€™re stamped or further processed (e.g., tumbled or edged). This aligns with their status as "articles" rather than flat-rolled products.

3. Review Product Specs: Larger gauge or diameter slugs may trigger reclassification to HS 7606.XXXX. Work with your supplier to adjust processing (e.g., additional edging) to reinforce the "article" status, if needed.
